Walter Nyambati, a former Kitutu Masaba MP, issued a fake cheque to his lawyer in an election petition against Governor John Nyagarama, it has been established.

Mr. Nyambati, whose Supreme Court appeal against Nyagarama is due this afternoon, however claimed that he had sacked the lawyer.

"He was to appear at appeals court in Kisumu during the judgment buy didn't show up. He is no longer representing us," said Nyambati's aide, Nicholas Kibeni.

Lawyer Osoro Mogikoyo, who is at the epicenter of the controversy, has been handling the petition ever since it was launched at the High Court.

In his own words, Mogikoyo dismissed claims that he had been dropped adding that he quit 'at his own will'.

"I asked someone to pick the judgment. It is not obvious that a lawyer goes during the ruling.

"What they are not telling you is that he gave me a cheque that bounced and I had to bow out of the case," he said.

During last years elections, Nyambati was President Uhuru Kenyatta's chief campaigner in the South Nyanza County.

At the Supreme Court, Osoro argues, Nyambati's case has dragged since he is not able to pay lawyer Omwansa Ombati who took over the matter.

The Supreme Court will verify the velocity of the case on Monday at a pre-trial conference hosted by Registrar.
