An Industrial and Labour Relations Court sitting in Kisumu on Thursday issued orders that restrains MCAs from Nyamira County from kicking out one of the most powerful minister.

Mr Bernard Osumo, the minister of Public Service Management, served the orders to the assembly on Thursday, a move that could give him temporary reprieve.

"You're hereby ordered not to interfere, discuss, summon or impeach the applicant, Mr Bernard Osumo until a matter raised is heard and determined by this court," read the orders from Justice Nduma Nderi.

Last week, MCAs unanimously supported a motion targeting Mr Osumo's removal. Of the 34 who attended the stormy sitting, 25 voted in favour of the motion. A committee has since been formed to probe him.

Among others, Osumo is facing abuse of office, gross misconduct and misappropriation of funds charges. He's accused of failing to pay Sh24 million to six workers who were seconded by TSC to Nyamira.

Leader of Majority Duke Masira dismissed the order, adding that the courts do not have powers to interfere with internal proceedings of the assembly.

"We have received orders but this will not stop us. We must protect the people of Nyamira and there resources. Courts cannot subvert justice. We are an independent institution," he argued 

Similar sentiments were echoed by former Kitutu Masaba MP Timothy Bosire, who asked Mr Osumo to step aside and allow investigations into his alleged misconduct.
