For the second time in three months, Employment and Labour Relations Court stopped recruitment process of Independent Electoral and Boundaries Commission CEO.
The position was left vacant following unceremonious exit of Ezra Chiloba in 2018, which was precipitated by audit queries surrounding 2017 polls.
On Friday, Justice Byrum Ongaya stopped interview processes of 10 people who had been shortlisted following an application by Chama Cha Mawakili.
The judge halted IEBC from conducting interviews until the case filed is heard and determined. The orders means Kenyans will have to wait a little bit longer to get new CEO.
In April, Justice Hellen Wasilwa stopped IEBC from shortlisting people following a petition that challenged among others, 15 years experience and NIS clearance.
“On the face of it, it appears that the advertisement need to be subjected to the test by this court before the process continues," the judge ruled.
The petition was filed by a man named Henry Mutundu, who says the requirements set by the IEBC are unfair and against the law.
He adds that the information held by Directorate of Criminal Investigations (DCI) and NIS cannot be used to determine whether one is clean or unclean for the top job.
“Security clearance by the DCI is unconstitutional and not supported by any law and there is no legal certificate that is granted to the affected persons,” he argued.
