[Photo|Nasa coalition]Opposition's NASA co-principal and Senate Minority leader Bungoma Senator Moses Wetangula has protested the move by President Uhuru Kenyatta to address the 12th parliament.Uhuru was scheduled to address both National and Senate Assemblies joint sitting at parliament buildings, Tuesday from 2:30pm, a session Wetangula said Nasa members would snub.Below is Wetangula's statement."Presidential elections are held during a general election of members of parliament. The general election is held on the second Tuesday in August in every fifth year. Between the general election and the time when a newly elected president assumes office the outgoing president exercises limited powers during temporary incumbency. The period of temporary incumbency is stipulated in the Constitution. The President does not have power to convene or schedule the opening of a new Parliament. This is as it should be under the doctrine of separation of powers and the independence and the exercise of the legislative authority. President Uhuru is therefore not entitled to address the opening of the newly elected Parliament. That is a duty that awaits the President who will assume office after being sworn in by the Chief Justice upon taking and subscribing the oath of allegiance and the oath for the execution of the functions of office as provided by the Constitution. The opening of parliament must therefore await the fresh presidential election which must be held under Article 140(3) of the Constitution and in accordance with the decision rendered by the Supreme Court of Kenya. NASA members of parliament will therefore not attend the purported opening of parliament on Tuesday 12th September 2017 as directed by the Speakers of both the Senate and the National Assembly. The position of President Uhuru currently and the nullification of his election by the Supreme Court of Kenya has undermined any legitimacy or authority he may have or may enjoy. This matter is simple and straight forward and requires no debate. HON.SEN.MOSES WETANGULA."
