Appeals Court sitting in Kisumu on Thursday upheld Governor John Nyagarama's victory, just a week after burying his son.
Former Kitutu Masaba MP Walter Nyambati, who finished second, had challenged the results at the court after losing at High Court.
Justice Kathurima I'Manoti, said the petitioner's case lacked merit this inadmissible.
In his application, Nyambati had named vote staffing, illegalities and irregularities among others as the basis to nullify the results.
For several minutes, ODM supporters broke into songs and dances after the ruling.
The ruling is a relief of Nyagarama, who had been out of the country for three months before his return last week.
Also, he is facing an industrial action by health workers who have downed tools for the last month.
Mr. Nyambati is a close ally of President Uhuru Kenyatta and was represented in court by lawyer Fred Ngatia.
