Supreme Court Judge Jackton Boma Ojwang has been suspended.
President Uhuru Kenyatta appointed a seven-member tribunal to probe his conduct.
The tribunal will be chaired by Justice Alnashir Visram.
The members of the tribunal will be Justice (Rtd) Festus Azangalala, Ambrose Weda, Andrew Bahati Mwamuye, Lucy Kambuni, Sylvia Wanjiku Muchiri and Amina Abdalla.
The tribunal will: “investigate the conduct of Justice Ojwang, Judge of the Supreme Court of Kenya “on the basis of Articles 168 (1) (e), 73 (1) (a) and 75 (1) and (2) of the Constitution and Judicial Service Code of Conduct and Ethics (Legal Notice No. 50 of 2003) and other relevant laws and matters.”
Ojwang will be investigated over allegations contained in a petition by the Judicial Service Commission of Kenya filed by Nelson Oduor Onyango and eight others.
The petitioners accused the judge of judicial misconduct in a case involving Migori Governor Okoth Obado.
He is accused of giving a favourable ruling and the governor, in return, tarmacked a road leading to the judges home in the county.
“The petition detailed instances which the petitioners believed constituted grounds of misconduct, impropriety, conflict of interest and breach of judicial code of conduct on the part of the Judge,” Chief Justice David Maraga said on March 20.
Justice Ojwang refused to appear before the JSC in person to respond to the allegations.
Now, the tribunal will submit a report and its recommendations to the head of state.
