The court has found Sirisia Member of Parliament John Waluke with a case to answer in the Sh297 million fraud charges pressed against him.

Magistrate Elizabeth Juma on Monday ruled that the vocal lawmaker and his two co-accused will have to avail and defend themselves in court.

Waluke, Grace Saparay Wakhungu and Errard Supplies and General Contracts Limited were also charged with defrauding the National Cereals and Produce Board (NCPB).

The court heard that the three, on June 27, 2013, issued a false invoice amounting to Sh115, 061, 838 as proof of arbitration between the company and the NCPB.

The maize in question was 40, 000 metric tonnes, the court was told, with the prosecution also claiming that the lawmaker was the one who made the contested invoice.

"On or about June 27, 2013 in Nairobi City County within Nairobi in the Republic of Kenya, being the directors of Erad Supplies and General Contracts Limited jointly and fraudulently acquired public property worth Sh13, 364,671.40 purporting to be costs for storage of 40,000 metric tonnes of white maize purportedly incurred by Chelsea Freight,” reads the charge sheet, as was seen by the Standard.

The court heard that the MP, using fraudulent ways, acquired the Sh297 million as cost of storing the maize.

Magistrate Juma set the hearing of the case for June 13, 2019.
