Murder suspect Joseph Irungu wants high court judge Justice James Wakiaga to recuse himself from his case.

Irungu alias Jowie said Justice Wakiaga demonstrated lack of impartiality during his bail application hearing.

In an affidavit, Jowie says Wakiaga had a predetermined mindset and did not pay attention to the evidence placed before him.

He adds that the high court judge depended highly on media reports and social media posts to determine whether to give or deny him bail.

The key suspect in the murder of Monica Kimani also takes issue with a comment Wakiaga made where he nicknamed him a male version of a slay queen or a woman eater.

"The picture that emerges from the prosecution's evidence as set out herein above, and that the bail report of the accused, is that he is a male version of slay queen. Which for lack of better terminology, I will call a woman-eater," Justice Wakiaga said.

This, Jowie says, embarrassed him greatly in the eyes of members of the public.

Wakiaga denied Jowie bail but released Jacque Maribe, his co-accused in the murder, on a Sh1 million bond.

"This court therefore orders that the first accused person remains in custody for the period of his trial and must be accorded proper treatment," the court added.
