The Court of Appeal in Mombasa upheld Mohammed Ali's August 8, 2017 election on Thursday, after Saedo who is Governor Ali Hassan Joho's cousin, filed a petition challenging his win.

Justice Martha Koome, while issuing the ruling, said Saedo's petition lacked merit.

According to the judge, the petitioner did not provide sufficient evidence to support voter bribery claims, alleged intimidation and alleged use of security officers to influence the election outcome.

"The appellant having failed to prove allegations of electoral malpractices, the court finds that the appeal is lacking merit and dismiss it forthwith," said Justice Koome.

Addressing the press after the ruling, Saedo said he respects the verdict delivered by the Court of Appeal, and further commended his lawyer, Mohammed Balala and his entire team of lawyers for their work.

"We respect the verdict delivered by the court of appeal in Mombasa today. We would like to thank Mohamed Balala and his entire team of lawyers for all the hard work they have put in," he said.

Saedo appealed the case after the High Court in Mombasa upheld Mohammed Ali's victory in February.

Ali who has since promised to deliver his manifesto to Nyali constituents vied as an independent candidate after Saedo trounced him ODM party nominations in April 2017.

"We thank the people of Nyali who have stood firmly with us and especially those who took time out of their busy schedules to attend different court sessions for which we are very grateful. We also thank the Almighty creator for bringing us thus far and we shall continue to wish Nyali well," added Saedo.
