The Court of Appeal in Kisumu has dismissed a case challenging the election of Bonchari Member of Parliament (MP) John Oroo Oyioka.

The petition was filed by former Bonchari Member of Parliament Zebedeo Opore.

Lack of evidence was the reason cited during the dismissal of the case at the appellate court.

In February, the High Court in Kisii dismissed a petition challenging Oyioka’s election, filed by Opore.

However, the former MP decided to appeal the decision.

“There were no vote discrepancies, no record was adduced to support such allegations in court to support the petitioner’s claims. The transposition errors noted on the scrutiny of votes affected all candidates and did not affect the outcome of the votes tallied,” Judge Antony Ndung’u of the Kisii High Court ruled in February.

Last week, five MPs survived election petitions at the Court of Appeal in Kisumu.

The five are: Bomachoge MP Charles Miruka, his Likuyani counterpart Dr Enock Kibunguchy, Shinyalu MP Justus Mugali Kizito, Luanda MP Christopher Omulele and Ikolomani MP Bernard Shinali.

However, the same court upheld Homa Bay High Court’s decision to nullify the election of Governor Cyprian Awiti.

Awiti has since moved to the Supreme Court to challenge the ruling.
