Garissa Governor Ali Korane has moved before the High Court in Nairobi seeking to stop a petition challenging his academic qualifications.

Governor Korane filed the application to strike out the petition that was filed by the father of a former Garissa County executive Idriss Aden Mukhtar who wants Korane removed as Garissa governor.

The governor through lawyer Ahmednasir Abdikadir asked the court to grant them more time to file a response to having the petition struck out.

The Independent Electoral and Boundaries Commission (IEBC) an interested party in the case, in their court documents claims according to the constitution, the petition challenging the removal of the governor should have been filed 28 days after the declaration of the election results.

IEBC further claimed that the court lacked the jurisdiction to hear and determine the petition.

High Court Judge Wilfrida Okwany granted the application and gave Governor Korane 30 days to file a replying affidavit.

Judge Okwany also directed parties in the case to file and serve their documents and responses before the mentioning of the case.

The matter will be mentioned on December 19, 2018.

The father of Idriss, Mr Aden Muktar Bare, moved to court last week to file the case saying his son was in the process of filing the case before the shooting on August 19.

Idriss was shot in the head and is currently in a coma in an Indian hospital.

Bare said the attempted murder of his son was because he was in the process of questioning the validity of Korane’s Masters of Business Administration certification.
