Lawyer Assa Nyakundi who is a suspect in the murder of his son Joseph Nyakundi is expected in court on Friday after his case failed to take place on Thursday as it had been scheduled.

Standard Media reported that the case could not take place after Nyakundi and his lawyer John Khaminwa together with the prosecution were told that the magistrate who was to oversee the case had allegedly gone to visit an ailing relative at Kenyatta National Hospital.

Nyakundi had initially been scheduled to take plea on October 16. Justice Jessie Lesit who had been promoted to a Court of Appeal judge however ordered for the case to be taken to Justice Daniel Ogembo citing that she was unable to oversee new cases.

Nyakundi who specialised in criminal law, was arrested and charged a Kiambu court for the murder of his son who was shot dead on March 17. 

Nyakundi nonetheless denied the charges when he appeared before Senior Principal Magistrate Teresia Nyang’ena. He was consequently released on Sh1 million bond or a cash bail of Sh300,000.

Kiambu Judge Christine Meoli withdrew himself from the case on the grounds of conflict of interest. 

According to Judge Meoli, she was a classmate to the accused.She therefore redirected the case to Milimani law courts in Nairobi.
