A High Court on Monday extended orders barring the Independent Electoral and Boundaries Commission (IEBC) from recruiting a new Chief Executive Officer (CEO).
The commission has now been taken back to the drawing board in its bid to replace its CEO following the resignation of Ezra Chiloba.
While delivering his ruling on the matter, Employment and Labour Court Justice Byrum Ongaya said that the commission has to wait until July 10, 2019, for the determination of the case on the process.
The extension comes after Chama Cha Mawakili (CCM) sought legal redress after the commission failed to adhere to the Constitution in the shortlisting of candidates to take over the post.
The body faulted the commission for failing to exercise transparency, competition and openness in the process. The commission was stopped from continuing with the interviews to replace Chiloba until the court cases are heard and determined.
“Pending interparty hearing or further orders of the court, there be a stay of the process of recruiting, selecting, interviewing, appointing or otherwise filling submissions the vacancy in the office of the Secretary and Chief Executive Officer of the IEBC,” read court the papers.
CCM argues that the continuation of the process is unlawful until the matter is addressed to satisfaction.
