The Office of the Director of Public Prosecution (ODPP) has issued a clarification on the case against Governor Okoth Obado and his aides.
In a tweet, ODPP noted that it does not intend to drop the murder charges against the governor and other two people who are co-accused in the case.
This came after reports on social media claimed that the the latter had withdrawn the case due to insufficient evidence.
"ODPP_KE(Director of Public Prosecution) has not & does not intend to drop murder charges against Migori Governor Okoth Obado as claimed on social media Obado & his 2 co-accused are charged with 2 counts of murder of former Rongo University Student Sharon Otieno & her unborn baby," reads a Twitter statement by ODPP.
Earlier, the DPP opposed an application by the accused to have Justice Jessie Lessit disqualified from the case.
In their application, the defence argued that Justice Lessit was biased in granting bail to Obado and denying them the same, yet the governor was more influential, and likely to interfere with witnesses.
According to DPP, this allegation does not meet the criteria for disqualifying a judge.
"DPP through Deputy Director Jacob Ondari opposed the application saying that the reasons given by the defense did not meet the basic test to disqualify a Judge. The case will be heard on 29th May 2019," reads a Twitter statement by DPP.
