A prosecutor has disqualified herself from handling criminal proceedings against an MCA in Nakuru Sub-county.
State Counsel Serling Joyce who appeared before Chief Magistrate Josephat Kalo on Friday applied to have herself suspended from the case and another prosecutor to take over for further hearing of the matter.
During the last mention, Kapkures MCA Paul Kimtai together with Richard Langat was granted time by the court to present progress of an out of court settlement deal with the complainant in a forgery case, however, the two requested for more time.
The matter has been marred with numerous delays.
Through their lawyer Gordon Ogolla, the duo informed the court that the agreement to settle the matter out of court was at an advanced stage.
They urged the court to give them more days.
According to the two, they are yet to reach an agreement with the complainant in the matter.
They, however, noted that both parties are willing to put the matter to rest.
The duo who was arrested in 2017, had been charged with forgery of land titles of a plot within Nakuru County.
It was alleged that on diverse dates between the month of October 2010 and April 2012 at an unknown place with intent to defraud Josiah Njoroge without lawful authority, the two made a title deed of a land situated at Mbaruk area in Nakuru purporting to be a genuine document issued by the land's registry.
They faced other charges of giving false information to police about the said land which led to the wrongful arrest of a land advocate in Nakuru.
The court heard that on April 14, 2014, at the CID offices in Nakuru County, the accused persons willingly gave false information to a police officer who was investigating the said forgery of the documents which led to the arrest and subsequent charge of an advocate wrongfully.
The two had pleaded not guilty and are out on a Sh200,000 bond with a surety of the same amount.
