Renowned lawyer and socio-political commentator Steve Ogola has waded into the Nairobi deputy governor debate.

Writing on Twitter on Thursday, the top lawyer held the view that the ruling Jubilee party has no power to nominate the Nairobi's deputy governor.

He said that the debacle in Nairobi county over a deputy governor can only be resolved by a supreme court advisory opinion or an interpretation of what the constitution says by the High Court.

"JUBILEE PARTY has no power to nominate Nairobi Deputy Governor unless there is judicial interpretation to that effect. The situation in Nairobi County truly requires judicial pronouncement: Supreme Court Advisory Opinion or constitutional interpretation by the High Court, " the lawyer said.

Governor Sonko has been without a deputy since the dramatic resignation of his deputy Polycarp Igathe over irreconcilable differences.

Last week, the flamboyant county boss nominated Ann Kananu Mwenda as his deputy at County Hall.

The Director of Public Prosecutions (DPP) Haji hit back after the nomination, terming it null and void.

The county boss is battling graft related charges and has been barred from office until his case is heard and determined.

The DPP argues that given a court order barring Sonko from stepping into his office, the governor cannot dispense the duties of the office until his case runs its course.
