The petition which was filed by a Nairobi resident, Moraa Gesicho argued that this will be an abuse of the court process. She noted that the BBI is only for purposes of gaining political relevance.

Gesicho also faulted the team, which she claims was unconstitutionally established, thus cannot submit the report to Uhuru.

However, in dismissing her petition, the BBI team pointed out that Moraa will not suffer any prejudice if the report reaches the head of state.

More so, the BBI task force revealed that they were editing the report before submitting it to Uhuru.

President Uhuru and ODM leader Raila Odinga came up with a task force, which they gave the mandate of going round the country to collect Kenyan views on the referendum.

The BBI team had revealed that they visited the 47 counties in the country.

During their visits, the task force states that it engaged all groups of people including women, people with disabilities and the elderly.

“BBI stands to be greatly prejudiced if it is not afforded an opportunity to be heard in the present petition,” said BBI team.

The main petition will be heard on  Wednesday, October 16.
