A court has ordered Moi University to pay 13 students Sh50, 000 each after their names were not included in the graduation list.
It has emerged that more than 2,700 students graduated at the institution on Thursday while 700 students were excluded from the list because of missing marks and other reasons.
Justice Pauline Nyamweya, who delivered her ruling in Mombasa, directed the institution to compensate the students for the losses they have suffered after they failed to be included in the varsity's 38th graduation ceremony.
The students’ attempts to be included in the list before the graduation date failed to bear fruits after the lecturers dodged them.
The 13 students are set to receive the said among after they resorted to legal redress following the failure of the university to address the issue. The court ruled that the failure of the university to include their names was not only discriminatory but also violated their rights as far as education is concerned.
“An order is hereby issued granting each of the petitioners herein an award of Sh50,000 as nominal damages for infringement of their rights as provided for in the Constitution,” ruled Justice Nyamweya.
According to Moi University Vice-Chancellor Prof Isaac Kosgey the students will be allowed to graduate in December if they will have cleared their fees arrears.
“All is not lost for them. They will still graduate in December once they clear their fees arrears,” he said as quoted by the Daily Nation.
