Senior Counsel Ahmednasir Abdullahi now says Kiambu Governor Ferdinand Waititu can still continue serving as county boss despite being ordered to keep off his office.
Magistrate Lawrence Mugambi on Tuesday released Waititu on a Sh15 million cash bail or a bond of Sh30 million and ordered him not to return to his office in Kiambu town until the Sh588 million corruption case he is facing is concluded.
“This Court will grant bail to the following accused persons and impose the following conditions: the first accused shall not access his office until this criminal case is heard and determined,” Mugambi ruled.
However, according to Abdullahi, the county boss can continue to discharge his duties by opening a new office in one of the major towns across Kiambu County.
"Since Babayao is barred from accessing the Governor's office in Kiambu, I offer the considered legal opinion that he can open a new office in Limuru or Thika or Gatundu or Kikuyu or Kiambaa & continue discharging his constitutional duties as Governor of Kiambu," the Senior Counsel tweeted.
Lawyer Prof Tom Ojienda, who is representing Waititu, termed the ruling to bar the Governor from accessing his office as 'discriminatory and unconstitutional' and indicated that he will be appealing.
Waititu was charged alongside his wife Susan Wangari and eight county staff on allegations of awarding tenders worth Sh588 million irregularly.
