Mr Alfred Obonyo, the step-brother to former Kibra MP Ken Okoth, says that the late legislator's mother was legally married to their dad before his demise.
A controversy is brewing over where Ken should be buried, with initial reports showing that he might be cremated in Nairobi after requiem masses.
Mama Angelina Ajwang, reportedly separated with her husband Nicholas Obonyo in 80s and moved to Nairobi to lead a single mother life.
But according to Mr Obonyo Junior, his father paid dowry in compliance with the Luo traditions, a move which compels the family to have Okoth buried in Rangwe.
In a statement on Tuesday, he told reporters that the community will not beg, but they will demand that the remains are interred next to his father's grave.
"Right now, by the fact that my father is not there, I am acting in full capacity on his behalf. What we are doing here, is a replica of what he could have done.
"His wish, is that his late son Ken Okoth to be brought up home and be buried next to him. We are not requesting Mama Ken, we are demanding. My father took some dowry to their place. My brother must be brought home and be buried here," he said.
On Wednesday, there will be prayers at Starehe Boys where Ken studied before the body is moved to Moi Girls in Kibra for viewership. On Thursday, Ken will be taken to his mother's home in Kadongo, Kabondo Kasipul.
Sources say that the body will be flown to Nairobi for a private cremation ceremony. He succumbed to cancer last week aged 41.
