Kisumu Chief Magistrate Julius Ng'arng'ar has found five former county officials from Siaya with a case to answer, in line with their alleged involvement in corruption.
The five; Amos Okello, Tobias Odongo, Kepha Marube, Zakayo Ojuok and Collins Owino are accused of defrauding the county Sh14 million in 2014.
The magistrate found that the group has a case to answer, in a suit where they are accused of executing a fraudulent Sh14.9 million tender between the county and Samko Traders Limited.
In the tender, Justice Ng'arng'ar heard, Samko Traders Limited was to supply and install assorted sports facilities.
In addition to the initial charge, Ojuok was also charged with forgery, over claims that he produced a fake document that aided in the award of the tender, during his time as procurement officer.
He was also charged with falsifying minutes of a meeting by the county tender award committee, while Okello, Owino, and Oloo were charged with accepting the letter.
However, the court acquitted former county works officer Thomas Mboya due to lack of evidence.
He had been accused of inspecting and signing an interim certificate, though the court found testimonies from Chibole Aura and Kenneth Omondi enough to clean his name.
"The fourth accused has no case to answer and thus dismiss the sixth count of the charges placed against him under Section 210 of the Criminal Procedure Code,” he said.
The case will be mentioned on November 18.
