The Inspector-General of Police Hillary Mutyambai has been sued by Braeburn Schools Ltd for contempt of court over a land tussle.
Mutyambai risks being handed civil jail term if the institution’s case at the court sails through.
Mutyambai found himself in the eye of a storm after it emerged that the 50.6-acre tract in Nanyuki, which the government is attempting to recover belongs to the institution.
The case was filed by Education Investment Company, which manages the school. The company also manages different institutions across the country.
According to the government, the piece of land has been reserved for the establishment of a textile factory. The project is being overseen by the Ministry of Industry, Trade and Cooperatives.
The government has said that land was fraudulently allocated to the institution. The schools’ director Robert Williams has dismissed the claims of illegally owning the land in question.
William argues that the land there are documents to prove the same.
The school reportedly bought the land in 2016 at a cost of Sh40 million. The management has also asked the court to list Laikipia County Commissioner Daniel Nyameti in the case.
The complainant argues that Nyameti and Mutyambai have decided to defy the orders from the court.
On August 8 Environment and Land Court Judge Mary Oundo directed the two parties to appear before it and shed more light on the same but they were nowhere to be seen on the expected date.
