The County Assembly of Kisumu has sought to have impeached Speaker Onyango Oloo's suit in court thrown out.

Oloo, who has since been replaced by North Kisumu Ward Representative Elisha Oraro has moved to court seeking a reinstatement and an order to keep receiving his allowances and benefits.

In his suit, he argued that the assembly unconstitutionally threw him out, adding that he was denied a chance to defend himself before the assembly as should be the case.

“The County Assembly of Kisumu illegally removed me from office without offering me a chance to defend myself,” reads the court documents filed by Oloo.

But the assembly is arguing that the ouster was lawful, with Oraro saying Oloo ignored his chance to defend himself.

In his affidavit, Oraro claimed Oloo was given an impeachment notice which he ignored, adding that the decision to oust him was made by the House Business Committee.

He claimed Oloo tried to access his office by force, with the help of goons, after his impeachment.

“The applicant (Oloo) made an appearance at about 9am on September 18, 2019 accompanied by goons. He tried to force his way into his former office,” he said.

The house is also accusing him of abuse of power, for allegedly imposing Kajulu MCA Roy Samo as his deputy, and attempting to have him take charge in his absence.
