Lawyer Ahmednasir Abdullahi now says Dr. James Nyoro's swearing-in ought to follow the law like the impeachment of Ferdinand Waititu.
The Kiambu Governor was impeached by the Senate on Wednesday, thus paving way for his deputy Nyoro to take over.
On Thursday, the Judiciary postponed Nyoro's swearing-in citing "unavoidable circumstances" although the solicitor general Ken Ogeto is said to have given the legal advice.
And Ahmednasir Abdullahi said the swearing-in must also be done in accordance with the law, seemingly poking holes to haste process of swearing-in Nyoro.
"Governor Waititu was IMPEACHED ACCORDING to the law. His deputy will be SWORN ACCORDING to the law," he said.
At least 28 Senators voted to uphold resolutions by Kiambu County Assembly which had kicked out Waititu.
Senate Speaker Kenneth Lusaka on Thursday also confirmed gazettement of Waititu's ouster, thus paving the way for Nyoro's swearing-in.
"I signed off a gazette notice after the vote was taken," Mr Lusaka told the Nation on Thursday morning.
"As to whether it has been published, I really can't say. But, yes, I signed it," he added.
