Orange Democratic Movement (ODM) has petitioned the government over Sh4.1 billion awarded to it by court of appeal after three years of legal battle.
The money is part 0.3 percent of the revenue collected between 2012 and 2016.
“We wrote to the Registrar of Political Parties after holding several meetings. The general public believes we already have the money which is not true,” said ODM Treasurer Timothy Bosire.
Ann Nderitu, who is Registrar of Political parties exculpated her office indicating that the money was to be collected in another institution.
"The Office of the Registrar of Political Parties, among others, is [meant] to administer the fund as and when received from the National exchequer. When the money will be availed, the office will carry out its mandate of administration of the funds,” she said.
When the funds are released , it will be shared among Wiper party and Ford Kenya based on the agreement in the registrar's office.
“ODM did not get a windfall but was awarded by the court what belongs to the party legally based on the 0.3 per cent meant for political parties,” said Bosire.
Acting Treasury CS, Ukur Yatani said that the funds which is to be paid to National Super Alliance (NASA) had been increased from 371 million to 871 million but did not mention the actual day of payment. He said that the delay was due to insufficient sources of money.
ODM indicated that it should be given 95 percent of the funds after garnering 40 percent of the total vote cast in 2013.
Political Parties act, section(25)(1) (b), clearly states that out of 100 percent of the money allocated, 5 Percent goes to the administration of the funds.
