City lawyer and political commentator Steve Ogolla has poked holes into Thirdway Alliance leader Ekuru Aukot's bid to force constitutional amendments through his much-hyped Punguza Mizigo Bill 2019.
Noting the process to change the supreme law is both legal and political, Ogolla said Aukot's Bill was doomed to fail because it lacked backing of leading politicians in the country.
In a tweet on Friday, the lawyer said Punguza Mizigo Bill will not see the light of the day since President Uhuru Kenyatta and his for-turned-ally Raila Odinga were opposed to it.
The President and the ODM boss are behind the Building Bridges Initiative (BBI) which is yet to table it report which is expected to recommend a referendum.
"Punguza Mizigo Bill was set to fail because of its dubious legality, and political neutrality. Amending the Constitution is a legal and political process. You cannot antagonize the President and the Hon. Raila Odinga, and expect to ride on their political constituencies to get past the vote," Ogolla said.
Out of 8 County Assemblies where Aukot's Bill has been debated, only Uasin Gishu has passed it.
Aukot accuses the political class of using unorthodox methods such as bribing Ward Representatives to reject his proposals.
"These politicians are only keen to retain power or create positions for themselves. These are political elites who use taxpayers’ money to bribe MCAs. But for us it is a big win. It shows that we have a good idea for the country and that is why Kenyans are discussing it. That is why politicians are fighting it because they don’t have big ideas," the former presidential candidate told the Standard, Friday.
