The state prosecutor Alexander Monda told the court that the widow of the deceased Amina Shiraz Yacoub is the mastermind behind the murder.

According to the prosecution, Shiraz hatched a plot to murder her husband to inherit his Sh500 million estate.

The court was told that the woman conspired with her American lover Jacob Schmalze to kill Jagatram in a bid to take over the wealth.

The accused persons reportedly drowned the tycoon in a swimming pool at Medina Palms in Watamu on June 26, 2015, before he was later pronounced dead.

It emerged that Schmalze later decided to flee back to the US after the police issued a warrant of arrest against him.

The Standard Digital also quotes the prosecution saying that the widow attempted to bribe a detective probing her deceased husband’s murder with Sh45,000 bribe but her efforts didn’t bear fruits.

Her defence team led by lawyers Jared Magolo and Ahmednassir Abdullahi, however, claimed that the witnesses were coached to bear false witness against their client.

The prosecution asked the court to examine the records carefully before the case can proceed to the next stage.

“All evidence shows the two - Yacoub and Schmalze - conceived an elaborate scheme to eliminate Baburam (Jagatram) and get access to his vast wealth," said Monda, as quoted by Standard.

"We, therefore, humbly urge you to scrutinise the records and find that the prosecution has discharged its burden and place the accused on his defence,” he added.
