Sebastian Maina Ngunju who wants the court to declare Zachary his son, is claiming that the latter's real name is Stephen Wachira, and wants his custody.

In a suit filed at the Milimani Law Courts, the applicant wants a DNA test conducted on Saitoti's widow Margaret Saitoti and the younger Saitoti to ascertain his claims.

In court papers seen by the Citizen Digital on Monday, the applicant says that the absence of his son has subjected him to agony, alongside his family members.

Ngunju, a teacher, says that his wife Elizabeth Njeri Maina gave birth to the young man in their Subukia home in 1985, before going missing on 31 August, 1988.

He also says that out of court applications by Margaret have been futile sue to interruptions by the latter, and also wants unrestricted access to the man he claims is his son.

“This case is the only remaining legal avenue available to me to access my son after the previous legal and out of court process attempts to settle the matter was thwarted by Margaret’s interference calculated at denying him and his family access to justice,” reads the papers.

He claims that Ms Saitoti later abducted the boy, also known as Zachary Musengi, who was aged 3, before putting him under her care.
