The Senate County Accounts and Investment Committee refused to grill embattled Samburu Governor Moses Lenolkulal on Thursday.
Explaining the basis of the move, the chairman of the committee Senator Moses Kajwang said that affording the county boss the opportunity to make his case in front of it would be acting in contempt of court.
"This committee and this Senate is bound to respect the rule of law. We would not wish to be accused of contempt of court. If the courts have ordered the governor not to access his office the governor, therefore, has no capacity to appear before this committee," the Homa Bay senator said.
Moses Kajwang said that the Samburu governor would only be accorded the opportunity to appear before the Senate Accounts Committee after being cleared by the courts.
Moses Lenolkulal faces an array of corruption charges in court, charges that he has strongly rejected.
The charges, leveled by the Ethics and Anti-Corruption Commission (EACC) include violation of procurement regulations and use of the tendering process for selfish gain.
Senator Kajwang' said the committee would be seeking clarity on whether a governor barred from office can still appear before parliamentary committees.
A court ordered Governor Lenolkulal to stay away from the county office until his case is resolved.
Another governor facing Lenolkulal's situation is Kiambu county boss Ferdinand Waititu.
