A court case took a dramatic turn in Kisumu after the prosecution failed to produce cake evidence.

The exhibit was part of the products allegedly confiscated during the arrest of two foreigners caught selling the goods in the country without documentation.

Chief Magistrate Beryl Omollo was told that the two, Lukyanenko Serphy and Kordupel Volodymir were nabbed while illegally cake and vegetables in Kisumu Town on June 11, 2019.

The case took a dramatic turn when the defence lawyer Onyango Onguso asked the prosecution to provide the evidence, while cross examining immigration officer Joseph Kiplimo.

“Where are the cakes or vegetables that were nabbed as exhibit from my clients’ house” Onguso was quoted by the Standard.

Kiplimo argued that the products are perishable and should not be expected to last that long.

He told that he launched investigations in response to concerns from members of the public regarding the two tourists' conduct.

Volodymir faced a separate charge of failing to renew his stay in the country after the lapse of the 90 day window, while Serphy was also charged with illegally baking cakes and failing to comply with visa regulations.

They were remanded for six more days at the Kodiaga Prison.
