Speaking at a Nairobi hotel on Wednesday during the opening of an international conference on police accountability in Africa, the DPP revealed that he has started reviewing the file in a bid to prosecute all officers linked to the incident.

Haji asked the family of the deceased to remain calm as the matter is being addressed by his office.

“DPP Noordin Haji is in the process of reviewing file on #BabyPendo in order to initiate prosecution of suspects found culpable as per the finding of the inquest for the death of Baby Samantha Pendo in 2017,” read a statement from the DPP’s office.

The parents of the infant who was murdered during the August 2017 post-election chaos, have been pleading with the DPP to ensure they get justice for their baby.

Five police commanders were found with a case to answer following Baby Pendo's death. An autopsy report revealed that the six-month-old baby died after suffering a head injury.

The officers under probe are Titus Yoma, (the then Kisumu County Police Commander), Bernard Kipkosgey Koima (Deputy Sub-County AP Commander in charge of the area), Christopher Mutune (former Kisumu East OCPD), John Thiringi, (the then OCS for Kisumu Central) and Linah Kosgey, (the then Nyalenda OCS).
