Former Nairobi Governor Evans Kidero has maintained that he is innocent amid the alleged mysterious loss of over Sh200 million from the county government, during his term in office.

On Wednesday, Kidero, asked the court not to admit evidence from one of the witnesses.

He argued that evidence by a witness from Equity Bank had nothing to do with the charges leveled against him. 

Kidero, who has been accused alongside others including Nairobi Finance Officer Jimmy Kiambaa, said that the court cannot use bank statements from the financial institution in the case against him.

He told the court that the financial statements the witness has presented in court have not been certified by the institution in question. 

Through his lawyer James Orengo, Kidero argued that a document can only be used as evidence in court, if it is certified and the description of the same given in a manner that can easily be understood by all the parties of interest in the matter. 

In response, the prosecution, however, told the court that it had not flawed any of the requirements of presenting evidence in court. 

Lawyer Joseph Riungu asked the court to dismiss the application presented by Kidero’s defense team in the case.

“The certificate is stamped, has an ID number and is also dated. Material contained in documents is the right information supplied in the computer during the process of data entry,” he said  as quoted by Citizen Digital.
