Monica Wangu Wamwere, the mother to veteran politician Koigi Wa Wamwere has moved to court in pursuit of justice for her alleged Nyayo era torture.

This follows the dismissal of her case where she was seeking compensation of Sh50 million from the Interior ministry, claiming that she was tortured during president Daniel Moi's tenure.

However, her move to the appeal after a defeat at the lower courts has since been dismissed, which has seen her move to the appex court in a bid to appeal the appellate court's ruling.

The court judges last month dismissed the case on grounds that the 89-year-old took too long to file the case, adding that she had no proof to back her allegations.

"We have no difficulty agreeing with the learned judge that the delay was inordinate and cannot be cured," said the appellate court.

The High Court had also argued that the decision to move to court ten years later was questionable, further throwing out her case, which pushed her to the appellate court.

“By this judgment, I have opined that whereas limitation of time may not be strictly applied, parties coming to court 10 years after the opening up of the floodgates of justice must explain themselves,” said the presiding judge.

Through her lawyer Gitau Mwara, Wangu had argued in court that she took time as she lacked trust in court due to the manipulation of the judiciary she witnessed during the Moi era.

She is now accusing the two courts of dismissing the cases on weak bases and wants the Chief Justice David Maraga's led court to hear her out.

Her son Koigi, also a former Assistant Minister, has also been pursuing compensation for the same reasons, claiming that he was repeatedly arrested and detained illegally by Moi's forces.
