A family of former Athletics Kenya (AK) boss Isaiah Kiplagat is living in fear of imminent eviction from its home in Karen, Nairobi county, after losing a case against a tenant.
This follows a December 23 ruling that the entire land on which the house is located, which is shared with a hotel owned by the family, be handed over to one Sarah Aleyo.
In the ruling, according to Standard, Business Rent Tribunal Chair Mbichi Mboroki said that the family doesn't have a claim over the property.
He ordered Lang'ata OCPD to enforce the handover of the land and house to Aleyo, who runs a salon on a rented room inside the hotel.
"The OCPD Lang’ata is to ensure that Aleyo and all her agents obtain quiet occupation and possession of the property known as 1160/381 Karen,” reads the ruling as quoted by Standard.
This was the result of the family's attempts to evict Aleyo, who has been operating inside the Royale Karen Hotel, over failure to pay rent in August 2017.
However, she moved to the tribunal and secured orders allowing her to stay.
In November, she was kicked out by the hotel and once again filed a suit, resulting in the ruling.
In its defence, the hotel management said that Aleyo was not even in any lease agreement with it and neither did she avail proof that she has been paying rent.
The hotel through its Manager James Gathirimu objected the handover of the entire hotel to Aleyo, arguing that she did not table any evidence to justify her claims.
“The order says the woman should take possession of the entire land and not the salon space. She did not even produce any evidence of paying rent or a lease agreement with the hotel’s management to justify her claim,” Gathirimu said.
