The murder case against city lawyer Assa Nyakundi has stalled.
On Thursday, Kiambu Principal Magistrate Teresiah Nyangena faulted Nyakundi’s lawyers for attempting to delay the case.
This after one of Nyakundi's lawyer Harun Ndumbi seeked for an adjournment, arguing that his colleague lawyer John Khaminwa was not present in court.
However, the Principal Magistrate directed Ndubi to make his submissions, adding that the case had already taken too long, yet the victims need justice.
“You cannot be making adjournments, you have to proceed,” she said.
The prosecution also accused the defence team of using tricks to delay the case from proceeding.
According to the prosecution, the defence has not been keen to see the matter progress, bringing one excuse after the other, causing delays.
Nyakundi is accused of murdering his son son Joseph Bogonko on March 17, last year.
He had been charged with manslaughter, but the Office of the Director of Public Prosecution filed for a review of the charge sheet, arguing that he should be charged with murder, since there is enough evidence to back the same.
Nyakundi's case will proceed on March 26, 2020, where a ruling is expected to be issued in regards to the DPP's application.
