Justice Jamila Mohammed insisted that the bail and bond granted by the High Court were reasonable thus could not be adjusted.

The court had given Waititu Sh15 million cash bail or a bond of Sh30 million which the governor said were too high for him to raise.

But besides reinstating the decision to block him from accessing office, Appeals Court said the terms given for Waititu's release were not excessive.

"Court also barred Governor Ferdinard Waititu from accessing office till the trial is concluded. It also dismissed his application to review (Sh30M bond with one surety of similar amount or Sh15M cash bail) terming them "reasonable & not excessive"," ODPP said.

Waititu is facing graft charges which have literally thrown him off balance. He's accused of fronting conflict of interest among other graft related issues.

MCAs on Thursday voted to keep him out of office, with 63 of them supporting the motion. His fate now lies in the Senate which will review the assembly's move.

However, the flamboyant governor has hinted a possibility of challenging his removal in court, arguing that the MCAs had no reasonable grounds.
