Independent Electoral and Boundaries Commission dispute resolution tribunal will decide the fate of footballer McDonald Mariga on Monday.

Commissioners Wafula Chebukati, Boya Molu, Abdi Guliye and a section of legal teams heard Mariga's petition following the disqualification from Kibra by-election race.

The team said it will issue a verdict on Monday whether or not the former Inter Milan midfielder will be allowed to contest Kibra by-election on Jubilee ticket.

Returning Officer Beatrice Muli defended her decision to disqualify Mariga, insisting that his name could not be found on the adopted voter register.

"As indicated, Mariga names details could not be found in the register and therefore the candidate is not qualified as per our checklist, as the RO guided with the regulations the law, therefore, guided me to invalidate the candidature of Mariga," she said.

Making his submission, renowned lawyer Elisha Ogonya said that the acknowledgement slip that the footballer holds was a confirmation that he was a registered voter as it was issued by the electoral body.

"The complainant is a holder of a voter’s waiting slip as issued by IEBC at the time he was before the returning officer. Upon registration, the slip is issued acknowledging you are registered voter, " Mariga's lawyer told the tribunal.

Mariga registered as a voter three weeks ago, and his name isn't part of those in adopted voter register. The Commission will make a decision on whether or not to allow him run.

Others in Kibra by-election race are Eliud Owalo of ANC, Imran Okoth of ODM and Eng Ramadhan Khamisi of Ford Kenya. The seat was left vacant following the death of Ken Okoth.
