Embattled Kiambu Governor Ferdinand Waititu has sent a letter to the Senate, decrying his impeachment by members of the Kiambu County Assembly.

Through his lawyers, Waititu argued that his impeachment was not done in accordance to the law.

He said the county assembly lacked the required quorum to pass the impeachment motion against him.

“From the commencement, the Assembly did not have the requisite statutory quorum at any particular time… The number of the Members of the Assembly is 92, thus the statutory quorum required under Section 33(2) of the County Governments Act to pass such a special motion is 62 members," Waititu said.

Last week, 63 Kiambu Ward Reps voted for his ouster, with only one voting against, while 28 members were absent.

The motion was presented in the assembly by Ndenderu MCA Solomon Kinuthia.

Waititu was impeached for allegedly engaging in graft, gross misconduct, abuse of office among other allegations.

The impeachment came at a time when the governor had been barred by the court from accessing his office, until his graft case is heard and determined.
