A lawyer accused of selling guns and bullets to businessperson Jimmy Wanjigi has been handed a reprieve after the court barred the Director of Public Prosecution (DPP) from pressing charges against him.
The lawyer, Memba Muriuki, had sold the firearms as well as bullets to the businessperson before the DCI launched investigations into the deal.
During the mentioning of the case on Tuesday, it emerged that the accused had filed an application at the High Court in Nairobi but the matter had not yet been determined until this moment.
In his presentation to Chief magistrate Wendy Kagendo, Memba said that a directive issued by Justice Roselyn Aburili on March 7, 2018, was still in place.
Muriuki had been ordered to appear before the court but he said that the Nairobi court had stopped the hearing and determination of the case.
The case is set not to commence as planned after the court issued a directive to Nyeri Chief Magistrate, Inspector General of Police and DPP over the matter.
Justice Aburili gave the lawyer a green light to file an application for the review of the case.
“Leave is hereby granted restraining the first and second respondents, or any other officer under their authority, from instituting or commencing a criminal proceeding, summons, charges or prosecution in criminal case number 252, which is pending for plea at the Nyeri Law Courts,” the order reads in part.
