Kenya's former Chief Justice Dr William Mutunga has weighed in on the alleged reluctance of the government to comply with court orders in the Miguna Miguna, and Moses Kuria cases.
Writing on Twitter in a reply to renowned socio-political commentator Patrick Gathara, the former chief justice said that the lawyers involved in the two cases should have those those violating the court orders subjected to punishment.
"I believe all the lawyers involved in both cases should seek to punish those involved in the disobedience of court orders for contempt of court. The disobedience of court orders is a subversion of the Constitution. Let all of us defend the Constitution under Art. 3(1)," Dr William Mutunga wrote.
The government has been accused of violating court orders for failing to allow controversial lawyer Miguna Miguna to return to the country.
In the case of Moses Kuria, who faces charges of assaulting a woman, the police have been accused of allegedly refusing to release the Gatundu South Member of Parliament in spite of him paying the bail money.
Elgeyo Marakwet Senator Kipchumba Murkomen has claimed that the orders to continue holding Kuria came from above but did not mention a name.
