Two brothers alleged to have stolen tractor ream and harvester valued at Sh 20,000 were released by a Nakuru court after the prosecution failed to avail the exhibits.
On Monday, the duo, aged 15 and 13, had pleaded guilty to the charges and were remanded at Nakuru central police station after an age assessment was ordered.
The report shown to court confirmed that the minors were indeed aged 15 and 13 as they had told the court when they took plea.
The two had been accused of stealing at Jumali farm in Njoro on October 30, 2015.
The court also ordered for a social inquiry report alongside the age assessment report but the probation officer was not present with the report.
Chief Magistrate Doreen Mulekyo questioned why the prosecution was not ready with the facts since the minors had already pleaded guilty to the charges.
She urged the minors never to repeat the mistake again. Mulekyo released the minors under section 210 of the constitution.
In the same court, a man was charged with resisting arrest after he was found with 21 rolls of bhang.
John Mburu was also accused of destroying a mobile phone belonging to one PC Ekai who was arresting him.
Mburu denied the charges and told the court that the officer started beating him leading to his resistance.
He was released on Sh15,000 cash bail and the case will be heard on January 25, 2016
