Dismissing the case, Justice Isaac Lenaola also noted that the two parties will cater for the costs of the proceeding at the High Court, Appelate Court and the Supreme Court.

The former presidential candidate had moved to the court appealing the dismissal of her case against election of the Kirinyaga boss by Appeals Court.

She had claimed that the gubernatorial election in 2017 had been marred with bribery. She further came out to note that Waiguru was using underhand tactics in this case.

“For a respondent who never came to court during hearing, but comes to court for judgment complete with a battery of media in tow and a celebration party, leaves one wondering whether she was aware of the outcome,” said Karua.

Dismissing her case at the Court of Appeal , the judges noted that Karua didn't provide enough evidence to prove that the elections were marred with irregularities.

However, Waiguru maintained her stand of wining the election in a free and fair manner.
