A Nakuru MCA accused of malicious damage of a perimeter wall belonging to the Beyond Housing Cooperative Society will be charged afresh in Court.
London MCA, Francis Njoroge will take plea again after the prosecution sought for time to amend the charge sheet with the allegations levelled against the politician.
They claimed that the charge sheet was defective as the dates indicated on the charge sheet did not match the actual dates of occurrence that the MCA is alleged to have committed the offence.
The mention of the matter was set for October 19, before the Principal Magistrate Wakumile Ndururu.
Njoroge was arrested on 26th August after he and others not before the court allegedly destroyed a perimeter wall belonging to the cooperative Society valued as Sh10 million.
It is alleged that the MCA with others not before court went to the piece of land located near Kobil Petrol Station and demolished the perimeter wall.
He is said to have hired goons armed with bows and arrows who ambushed the building surrounding and chased away the guards before trampling done the wall.
The prosecution had applied for the accused to be remanded at the Nakuru Central police Station arguing that after he was released on police cash bail he ganged up with others not before court while armed with bows and arrows, proceeding to the station where he they allegedly threatened OCPD, Bernard Kioko.
They had therefore pleaded with the court to have the MCA remain in custody as they were intending to add more charges against him.
Njoroge's lawyer, Hari Gakinya had termed the application as politically motivated and the prosecution had not submitted any legal basis upon which they would hold the accused.
He argued that that was no compelling reason to deny him bond and being a holder of a constitutional office he would not jump bail.
The MCA is out on a cash bail of Sh200 000 or a bond of Sh2 Million.
