Giving the ruling on Wednesday Eldoret High Court judge Hellen Omondi observed that the petitioner errored in enjoining the Commission on Revenue Allocation and the Attorney General as interested parties saying it did not meet the definition of interested parties rule.

“From the aforegoing, I hold that it is this limb of preliminary that is merited and the petition is dismissed with costs to the respondents," the Judge said.

MCAs had approved the Act giving them control of 40 per cent of the funds through the wards but Uasin Gishu governor Mandago declined to sign it into law but MCAs unanimously overrode his veto the second time, effecting the law without Mandago’s signature.

Governor Mandago had opposed the Act through which each of the 30 wards will receive Sh43 million for development, which amounts to more than Sh1.5 billion annually.

The County Government of Uasin Gishu has already begun to implement the historic act by conducting elections in the 30 wards.

They will manage Uasin Gishu County Equitable Ward Development Fund and implement ward projects for a term of 3 years.

Each ward will receive Sh30 million to fund development projects.
