An application to drop all charges by an accused man facing defilement charges was turned down by a Nakuru court on Monday.
Godwill Kiplagat Kiptet is facing charges of defilement of a 15 year old girl with whom they have a child together. The intention by the accused for applying for the withdrawal of the case has been heard by the court but the prosecution has objected. He says that his girlfriend is willing to withdraw the case against him but her father has objected the move.
In her ruling, Resident Magistrate Judicaster Nthuku said that the withdrawal of a case is determined by the office of the director of public prosecutions. It is represented by the prosecutor of the court, chief inspector Kamau who opposes the matter.
Nthuku questioned the denial of the charges by the accused who admitted that he has a child with the complainant by asking how the complainant conceived the child.
“We have two children in this matter, a 15 year old and her child, whose interest should we choose to preserve?,” she asked. Nthuku then ordered the case to proceed for hearing.
The case will be mentioned on December 17.
