A successful plea bargain by a man who had admitted that he had killed a businessman and slapped with eight years behind bars have made his case to restart.
Ngira Charo had pleaded guilty of killing Issack Sokorow on March 8, 2018, in the coastal town of Malindi.
Charo told the court that he only acted as a hired assassin of Kilifi county government's driver, Mandi Jilani and Makonde Ruwa as a move to attract a lesser sentence but the deal fired back as he was made a state witness instead of testifying against the two.
in June 2019, Charo rescinded his statements while talking to lawyers; Jared Magolo and Daniel Wamotsa, representing the two co-accused, pointing out that the investigative officers had forced him to write a false statement that inculpated the two, Jilani and Ruwa.
He also admitted that he feared the officers in Malindi that forced him to record a statement narrating how Jilani had hired him.
He said that he killed Sokorow by strangling him.
Senior Assistant Director of Public Prosecutions Alloyce Kemo proposed fresh investigations on the matter and a new date set for the hearing of Charo's case alongside Jilani and Ruwa.
Justice Ogola ordered a fresh trial for the trio after a successful DPP intervention.
“In the course of proceedings, Kemo, learned counsel for the prosecution, observed that the evidence of the accused appeared to be contradictory to the terms contained in the plea bargain agreement,” said Justice Ogola, as quoted by Standard.
Also, Justice Ogola faulted the new application by Charo with the DPP saying that it was different from an earlier one dated on April 8, 2019, the day he was sentenced.
