Renowned lawyer and social-political commentator Steve Ogolla has weighed in on a ruling that will see embattled Embakasi East Member of Parliament Babu Owino, pay his Sh 10 million bail in installments.
In a tweet on Tuesday reacting to the development, Ogolla described the ruling as a relief to the poor people, who he argued are not in a position to make bail payments in one installment.
Babu Owino faces attempted murder charges following a shooting incident at Nairobi's B Club, in which he is alleged to have pulled the trigger.
He, however, suggested that the judge's order that Babu settles the costs incurred in the treatment of the victim, run the risk of presuming his guilt even before trial.
"Judiciary is innovating. That bail can be staggered is a welcome relief to the poor who are unable to pay in one installment. The problem with Hon Andayi's ruling is that by directing Babu to pay medical cost the court suffers the challenge of convicting the accused before trial," Ogolla tweeted on Tuesday.
DJ Evolve who was shot during the incident is fighting for his life at Nairobi hospital.
