Elgeyo Marakwet Senator Kipchumba Murkomen made a passionate appeal to Chief Magistrate Douglas Ogoti not to generalise the bail terms for suspects in the Kimwarer and Aror dams' scandals.
In his submission on Tuesday, Mr Murkomen contended that it would be unfair to generalise the bail terms given the fact that the suspects are facing varying charges, their duration at their positions was not the same, and that they occupied different positions in the pecking order.
"Not everybody is facing the same charges, your honour, " the senator argued.
Murkomen, who represented the suspects, said that members of the KVDA staff arrested were juniors who were earning meagre salaries
He pleaded with the magistrate not to treat them in the same way as other suspects.
The legislator also pleaded on behalf of the East African Community (EAC) permanent secretary Susan Koech, saying she had been in the ministry for months and not during the period crimes the DPP charged her with are alleged to have happened.
The Director of Public Prosecutions (DPP) Noordin Hajji called for the arrest of the suspects on Monday in a press conference as he uncovered charges in his indictment.
Chief Magistrate Ogoti will make a verdict on the bail applications later today.
