Supreme Court justices. Three reasons why NASA won't petition Uhuru's second re-election victory. [Photo: NMG]As days go by, National Resistance Movement (NRM) leader Raila Odinga options continue becoming scanty. For instance, mass demos are increasingly becoming unpopular among 'Nasarites' after some lost their lives in violent police confrontations. Property worth millions of shillings has also been torched or destroyed leading to loss of several jobs in Nasa strongholds. Therefore, this is not a path Nasa wants to keep following because little will come from it.Odinga and his resistance movement, the first in post-independence Kenya, however, have the Supreme Court option at least till Monday when 7 days for filing a petition challenging President Uhuru Kenyatta October 26 victory, elapse. But Nasa won't file any petition. This is why.First, there is huge fear among NASA principals that the Supreme Court may not nullify Uhuru's re-election. By not nullifying, the presidential election court will simply be validating the election. A valid election means the end of NASA cause. Raila doesn't want to give Uhuru such space to think he is legitimately in office.Second, NASA might feel it has no moral ground to challenge an exercise it wasn't part of. It really doesn't make sense. Does it?Finally, challenging the election means that Nasa acknowledges that an election took place on October 26. According to NASA, there hasn't been any election in Kenya since August 8.The resistance movement has promised Kenyans a free, fair and verifiable election in 90 days. How the promise will be executed, even NASA itself doesn't seem to be so sure.
