The judge is accused of receiving sh200 million shilling bribe to help in delivering favorable judgment to the case challenging Nairobi governor ,Evans Kidero from office.

The petition to remove Kidero from office was filed by his opponent, Ferdinand Waititu.

Omtatah, on the other hand, filed a petition to challenge the tribunal which was formed by President Uhuru Kenyatta.

The president picked lawyer Sharad Rao to chair the tribunal which attracted critics from some lawyers saying the president did not abide to the constitution. Some lawyers said Rao was not supposed to chair the committee because of his age.

During the ruling of Omtatah’s petition, Judge Joseph Onguto said that the matter was of public interest and, therefore, the tribunal should go on with their probing. The judge also said the matter raised by Omtatah could be handled by the tribunal even before it starts the exercise.
